On 08/02/2017, North Coventry Twp. Police were participating in a departmental PA Aggressive Driver speed enforcement detail on Route 422 west at S. Keim St. At approximately 2045 hrs., police were directed to a blue 2017 Chevrolet and advised that the Chevrolet was traveling 71 MPH in the posted 40 MPH zone. Police stopped said vehicle and made contact with the driver. The driver advised Police that he did not have his driver's license on him. The driver identified himself as Matthew Shenk, and provided a date of birth and home address. Police located a PA Driver's License for the name and date of birth provided by the driver. Police issued a traffic citation to the driver for PMVC 3362(A)(3) Maximum Speed Limits Established Zones.
On 09/26/2017 Police attended the summary traffic hearing for Matthew T. Shenk at District Court 15-3-01. Prior to the hearing, Police spoke with Matthew T. Shenk in regards to the traffic citation, that was issued on 8/2/17 at 2045 hrs. Matthew T. Shenk advised Police that he was not the driver of the 2017 Chevrolet, at the time of this stop. Matthew T. Shenk advised that his brother, Larry James Shenk, the defendant, drives the 2017 Chevrolet. Police then withdrew the traffic citation in front of District Justice Judge Brown.
Police ran the defendant's PA Driver's License. This license was found to be suspended. Police viewed the defendant's license photo and confirmed the defendant as the driver of the 2017 Chevrolet on 08/02/2017. On 09/30/2017, Police spoke with the defendant in regards to this investigation. The defendant said that on the night of the traffic stop he gave Police his brother's (Matthew Thomas Shenk) personal information because he did not have his PA ID with him and that his PA Driver's License was suspended. The defendant said that he was scared and did not know what was going to happen to him at the time of the stop.
The defendant was charged with PACC 18 4914(a) False Identification To Law Enforcement, PMVC 75 3362(a)(3) Maximum Speed Limits, and PMVC 75 1543(A) Driving while Operating Privilege is Suspended.
