The Kennett Square Police Department is launching a compliance initiative to address speeding, noisy, and unsafe equipment violations. This campaign aims to promote safer roads, quieter neighborhoods, and better adherence to Pennsylvania laws through education, community collaboration, and enforcement.
Why This Matters
Speeding and excessive vehicle noise disrupt public safety and quality of life. Speeding increases the risk of accidents, while loud exhaust and stereos disturb residential areas and the business district. They are among the top concerns of our citizens and visitors. By addressing these issues, we aim to create safer streets and more peaceful communities.
What the Law Says
1. Excessive Speeding (Title 75 § 3361, 3362, 3365)
- Driving above the posted speed limits or faster than is reasonable under road conditions.
2. Unreasonable Noise (Title 18 §5503(a)(2))
- Loud music or noise that causes public inconvenience or alarm.
3. Exhaust Violations (Title 75 §4523 and Title 67)
- Mufflers and exhaust systems must be in "good working order."
Key Case Law:
- Commonwealth v. Baily (2008): Officers may stop vehicles based on reasonable suspicion of loud exhaust systems, even without specialized equipment.
- Commonwealth v. Strickhouser (2023): Trained officers can initiate stops for further investigation if exhaust noise suggests non-compliance.
What Constitutes a Violation?
Disorderly Conduct (Noise):
- Duration: Sustained disruption (e.g., prolonged idling with loud stereos).
- Intent: Actions clearly meant to disturb public peace (e.g., targeting neighbors with noise)
Exhaust Systems:
- Modifications that amplify engine noise (e.g., removed mufflers, bypassed "straight pipes").
Compliance Strategies
1. Focused Traffic Stops
- Officers will conduct traffic stops for observed and head violations (e.g., excessively loud exhausts during patrol).
- Violations may result in citations, warnings, or enforcement of other present equipment or moving violations.
2. Community Collaboration
- Residents are encouraged to report recurring disturbances to police dispatch at 610-268-3171.
- Tips can help identify repeat offenders.
- Email notification for incidents not currently in process can be sent to tips@kennettsquarepolice.org.
Compliance Checklist for Vehicle Owners
- Ensure mufflers and equipment are intact and in compliance with Pennsylvania's equipment standards.
- Avoid stereo volumes that disrupt neighboring homes or businesses.
- Drive the posted speed limit to ensure you're safely traveling on the roadway.
