NCPD wants to inform the community regarding the new distracted driving law taking effect June 5, 2025. PA vehicle code 3316.1.
Paul Miller’s Law bans having a cellphone in hand in Pennsylvania while operating a vehicle, even while stopped at a red light unless using it to communicate with law enforcement or other emergency services.
There will be a 1-year warning period where a warning is to be issued to the driver who commits this offense. Starting on June 5, 2026, drivers who commit this offense can be cited with a summary offense and upon conviction, be fined $50.
The new law, being called the Paul Miller law (Senate Bill 37), was advocated for as a result of a crash which took place in 2010 on Route 33 near East Stroudsburg University in Monroe County. Miller died in the accident which was caused by a 28-year-old driving a tractor trailer who was reaching for a cellphone that had fallen under his seat.
